Terms & Conditions

1. About these Terms

These terms and conditions govern your purchase of tickets to, and attendance at, events run by Infynite ( "Infynite", "we", "us", "our"), a sole trader events business operated by Gemma Rooney (ABN: 58 734 079 865), based in the Sutherland Shire, NSW, Australia 

 

By purchasing a ticket or registering for any Infynite event, you agree to be bound by these terms. Please read them carefully before completing your purchase. Questions? Contact us at infyniteconnections@outlook.com

2. Ticket purchases

All tickets are sold through our website at infynite.com.au via Wix Events. 

 

By completing a ticket purchase you confirm that:

  •  You are 18 years of age or older (or the minimum age stated for the specific event) 

  • The information you have provided is accurate and complete 

  • You have read and agree to these terms and conditions 

  • You have read and agree to our Code of Conduct (Section 6) 

  • You have read and acknowledge our Privacy Policy at infynite.com.au/privacy-policy 

 

Tickets are non-transferable. Infynite reserves the right to refuse entry to any person who does not meet the event's stated requirements. In such circumstances refunds remain at Infynite's sole discretion.  

 

Only one ticket may be purchased per person. Each person wishing to purchase a ticket to an event must purchase their own ticket and agree to these terms at the time of purchase. 

 

Each ticket entitles the purchaser to entry to a single event on the date specified on the ticket. Tickets may not be used for commercial, business or resale purposes. Infynite reserves the right to cancel any ticket that has been resold or transferred in breach of these terms, without refund.

 

All prices are in Australian dollars and include GST at the applicable rate, unless otherwise stated. All payments must be made in full prior to ticket delivery.

Tickets will be delivered electronically to the email address or through the digital portal specified at the time of purchase, or physically where such option is requested and available.

 

Infynite accepts no responsibility for non-receipt of tickets arising from incorrect information or technical difficulties outside its control.

 

Lost or stolen tickets may not be reissued except at Infynite's sole discretion. Requests must be made in writing to infyniteconnections@outlook.com.

 

If a ticket is not received within 24 hours of purchase, you must notify Infynite promptly for reissue.

 

Online ticket purchases are subject to these terms and any additional policies displayed at checkout. By completing an online purchase, you affirm your acceptance of these terms.

3. Refund and cancellation policy

All ticket sales are final. Infynite does not offer refunds for attendee-initiated cancellations for any reason, including but not limited to: change of plans, illness, work commitments, or personal circumstances.

 

 ​I. Ticket transfers: 

Tickets are non-transferrable. 

 

II. If Infynite cancels an event: 

If we cancel an event for any reason, ticketholders will be offered either a full refund to their original payment method or a credit toward a future event, at Infynite's sole discretion. We will notify all ticketholders by email as soon as a cancellation decision is made. If we move an event to a new date, we will notify all ticketholders by email. Infynite reserves the right to transfer tickets to the rescheduled date, issue credits, or offer refunds at our sole discretion. ​ 

 

III. Extreme circumstances:

Infynite may, in its absolute discretion, consider requests for refunds or credits in cases of serious medical emergency or bereavement. This is not an entitlement and is assessed on a case-by-case basis. Email infyniteconnections@outlook.com with a brief explanation. Infynite's decision is final. ​ 

 

VI. Force Majeure

Where an event cannot proceed due to a force majeure event, Infynite may cancel, reschedule, or otherwise alter the event.

 

Infynite will endeavour to provide refunds or alternatives as required by law and these terms.

 

Force majeure includes any circumstance beyond the reasonable control of Infynite, including but not limited to government actions, pandemics, epidemics, quarantine, public health orders, natural disasters, war, terrorism, cyber-attack, strikes, industrial actions, or acts of God, rendering the performance of the event impossible, impracticable, or unsafe.
 

IV. Code of Conduct breaches and breaches of terms:

If you are asked to leave an event due to a breach of the Code of Conduct (Section 6), or if you have breached another section of these terms and conditions (such as providing incorrect information, or purchasing a ticket when you do not meet the event guidelines e.g. minimum age and age bracket – see clause 4 below),  no refund or credit will be issued under any circumstances.

 

V. Availability

All tickets are offered subject to availability. Infynite is not obliged to accept any order or reservation.

 4. Age requirements and event eligibility

All Infynite events are strictly for adults aged 18 years and over unless otherwise stated. ​ 

 

Some events are designed for specific age brackets (e.g. 18–25, 25–35, 35+). By purchasing a ticket for a specific age-bracket event, you confirm that you fall within that bracket. 

 

Proof of age may be required on entry to any event. Infynite reserves the right to refuse entry to any person who cannot verify their age.

 

Infynite reserves the right to refuse entry if these requirements are not met, with no refund issued.

5. Liability

To the fullest extent permitted by Australian law, Infynite excludes all liability for:

  • Any loss, injury, theft or damage suffered by an attendee at or in connection with an Infynite event 

  • Any loss or damage to personal property brought to an event 

  • Any consequential, indirect, or special loss or damage of any kind ​ 

 

To the extent permitted by law, you indemnify Infynite, and its agents and employees, against all claims, demands, damages, liabilities, expenses and losses arising from or resulting, either directly or indirectly, from your actions, whether in breach of these terms or otherwise, or attendance at an event. 

 

The liability of Infynite in damages (including special, indirect or consequential damages) in respect of any act or omission of Infynite in connection with its obligations under these terms and conditions will not exceed the cost of your ticket.

 

Nothing in these terms limits any rights you may have under the Australian Consumer Law that cannot be excluded by contract. Infynite holds public liability insurance.

6. Code of Conduct

By attending an Infynite event, you agree to the following: ​ 

  • You must comply with all laws, venue policies and directions from Infynite. 

  • You must treat all attendees, staff of Infynite and staff of any venue with respect, regardless of age, gender, sexuality, background, or appearance 

  • You must take no for an answer — if someone is not interested in continuing a conversation, respect that immediately

  • You will not touch anyone without their clear consent 

  • You will not follow, body block, or persistently approach someone who has indicated they are not interested 

  • You acknowledge and agree that harassment, intimidation, aggressive behaviour, or unwanted physical contact will result in immediate removal from the event, at Infynite's sole discretion

  • You will drink responsibly — intoxicated behaviour that affects other attendees will not be tolerated

  • You will not attend any event under the influence of any illegal drugs, or bring any illegal drugs to an Infynite event 

  • You will not photograph or film other attendees without their explicit permission ​ 

  • You will comply with the terms of entry to any venue where an event is held, and the directions of staff of any such venue

 

Infynite reserves the right to remove any attendee from an event at any time, without refund, if they breach this code or if their behaviour is deemed by Infynite to pose a risk to the safety or enjoyment of other attendees.

 

Infynite reserves the right to report the conduct of an attendee to the police in the event that any act by an attendee is considered by Infynite to be in breach of the laws in the jurisdiction where an event is held. No claim may be made against Infynite or their staff in such circumstances.  

 

Staff at any venue may also remove any attendee from an event at any time, without refund, if the staff consider that the attendee is in breach of the terms of the venue. 

7. Photography and video

Infynite events are photographed and filmed for use on social media (TikTok, Instagram) and other promotional materials. 

 

By purchasing a ticket, you acknowledge that filming may occur at the event. ​ If you would prefer not to be filmed, please inform an Infynite staff member privately when you arrive or at any point during the event. 

 

Your preference will be respected immediately and without question. 

 

​If you are featured in any published Infynite content and would like it removed or your face blurred, email infyniteconnections@outlook.com. We will endeavour to act on all removal requests within 48 hours. 

8. Information collection

Infynite will collect, use, and store personal information for the purposes of administering events, processing ticket purchases, communicating with you, verifying eligibility, and as required by law.

 

Personal information will be handled in accordance with the our Privacy Policy, the Australian Privacy Principles under the Privacy Act 1988 (Cth), and all applicable privacy laws.

 

Personal information may be disclosed to venues and other third parties for ticket delivery, event administration, or as required by law.

 

By purchasing a ticket, you consent to the collection, storage, disclosure and use of your information as set out above.

9. Alcohol and venue rules

 Many Infynite events are held at licensed venues. Alcohol service at these venues is governed by the venue's liquor licence and the responsible service of alcohol (RSA) obligations of venue staff. 

 

Infynite is not responsible for alcohol service at venues. Attendees are expected to drink responsibly. Infynite and the venue reserve the right to refuse service to or remove any attendee who is excessively intoxicated. 

 

​ All attendees must comply with the rules of the venue hosting the event and the directions of the venue's staff. Failure to do so may result in removal from the event without refund.

10. Health and safety

 Infynite takes the safety and wellbeing of all attendees seriously. By attending an event, you agree to: ​ 

 

  • Follow any safety or emergency instructions given by Infynite or venue staff 

  • Not attend if you are feeling unwell in a way that may affect other attendees 

  • Take reasonable care for your own safety and the safety of others at the event 

 

​ In the event of a medical emergency, Infynite will contact emergency services (000) and take all reasonable steps to assist. Attendees are encouraged to inform Infynite of any medical conditions that may require attention during the event. 

 

Accessibility

 

Infynite will take reasonable steps to ensure events and venues are accessible for persons with disabilities in accordance with applicable law, including the Disability Discrimination Act 1992 (Cth). Some events may not be suitable for all individuals. 

 

If you require reasonable adjustments or accessibility accommodations must notify Infynite at infyniteconnections@outlook.com prior to the event.

11. Event changes

Infynite reserves the right to change event details including date, time, venue, format, or capacity at any time. We will notify ticketholders of any material changes by email as soon as practicable. Where a change is significant, ticketholders will be offered a credit or refund at Infynite's discretion.

12. Intellectual property

 Many Infynite events are held at licensed venues. Alcohol service at these venues is governed by the venue's liquor licence and the responsible service of alcohol (RSA) obligations of venue staff. 

 

Infynite is not responsible for alcohol service at venues. Attendees are expected to drink responsibly. Infynite and the venue reserve the right to refuse service to or remove any attendee who is excessively intoxicated.

13. General

I. Severability

If any provision or part provision of these terms is illegal, void, or unenforceable, that provision may be severed and the remainder will continue in force.

 

II. Transfer of Rights

Infynite may transfer its rights and obligations under these terms to another business or successor, providing notice to you; such transfer will not adversely affect your rights.

 

You may not transfer their rights or obligations under these terms without Infynite's prior written consent.

 

III. Entire Agreement

These terms, together with any policies expressly referenced herein, constitute the entire agreement between you and Infynite concerning events and tickets and supersede all prior communications, representations, or agreements, whether oral or written.

 

IV. Governing law

These terms are governed by the laws of New South Wales, Australia. Any disputes arising from these terms or your attendance at an Infynite event will be subject to the exclusive jurisdiction of the courts of New South Wales.

Privacy Policy

1. Who Are We

Infynite is a sole trader events business operated by Gemma Rooney (ABN: 58 734 079 865), based in NSW, Australia. We run in-person singles and social events and sell tickets through our website at infynite.com.au. ​

 

We are subject to the Australian Privacy Act 1988 and the Australian Privacy Principles (APPs). This policy explains how we collect, use, store, and protect your personal information. This includes information we collect online (both on social media and via our website and email), over the phone, in person at our office and at our events​ Questions?  2. What information we collect

When you purchase a ticket or join our waitlist, we collect your:

 

  • First and last name 

  • Email address 

  • Phone number

  • Date of birth / age (for age-appropriate event allocation)

  • Gender (for event format purposes) 

  • Payment details — processed securely by Wix Payments or Square. We do not store your card details 

  • Any additional personal information you provide to us, or authorise us to collect, as part of your interaction with us.​ 

 

We may also collect information you provide voluntarily, such as feedback after events or responses to surveys

 

The personal information we collect is only the information reasonably necessary to carry out our business and to provide services. We may also collect information to fulfil administrative functions associated with these services, for example billing, entering into contracts with you and/or third parties and managing events.

3. How we use your information 

Provision of Services

We use your personal information to: ​

  • Process your ticket purchase and confirm your booking

  • Send you event confirmation and reminder emails 

  • Manage your attendance at events (e.g. guest list, age group allocation) 

  • Send you event updates and future event announcements (if you have opted in)

  • managing, planning, advertising and administering events;

  • researching, developing and expanding our events and services;

  • informing you of our activities, events and services;

  • Respond to enquiries or complaints 

  • Comply with our legal obligations

  • Defend against chargebacks or disputes ​

 

We also collect and uses personal information for market research purposes and to develop and deliver new or improved services and events.

 

We will never sell your personal information to third parties.

SMS Marketing

If you have opted in to SMS communications, Infynite may send you event reminders and updates by text message to the phone number provided at checkout. Message and data rates may apply. Your SMS opt-in data and consent will not be shared with or sold to any third parties for their own marketing purposes. ​ To opt out of SMS messages, reply STOP to any message, or email infyniteconnections@outlook.com.

5. Disclosing your information

We will only disclose personal information in accordance with the Privacy Act ("Act").

 

This means that personal information may be disclosed:

 

● For the purposes for which we have advised that we are collecting it, and for related purposes that the individual would reasonably expect,

● Where we have the consent of the individual to do so,

● As required by law, or

● Under other circumstances where permitted under the Act.

 

In the course of our business activities, we may need to disclose some of your personal information to relevant staff, or venues for the purposes of running events.

6.  Photography and video at events

 Infynite events are photographed and filmed for use on social media (TikTok, Instagram) and other promotional purposes. By purchasing a ticket, you acknowledge that filming may occur.

 

 If you would prefer not to be filmed, please inform Infynite staff privately when you arrive or at any point during the event — your preference will be respected immediately.

7. Data storage and security

Your personal information is stored securely within the Wix and Mailchimp platforms, which use industry-standard encryption. The personal information is stored in secure databases overseas.  We retain your personal data for as long as necessary to provide our services and comply with legal obligations — typically no longer than 3 years after your last interaction with Infynite. ​ We do not store payment card details — all payment data is handled directly by Wix Payments or Square

 

Our websites do not necessarily use encryption or other technologies to ensure the secure transmission of information via the internet. Users of our websites are encouraged to exercise care in sending personal information via the internet.

8.  Your rights

Under the Australian Privacy Act 1988, you have the right to: ​ 

 

  • Access the personal information we hold about you

  • Request correction of inaccurate or out-of-date information 

  • Request deletion of your personal data (subject to our legal obligations)

  • Opt out of marketing communications at any time 

  • Lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au ​

9. Access to personal information

You are entitled to access your personal information held by Infynite on request. To request access to your personal information please contact our privacy officer on infyniteconnections@outlook.com.

 

Individuals will be able to access their personal information upon formal written request. However, Infynite may occasionally need to deny access to information in accordance with the exemptions contained in the Act. Requests will be responded to within 30 days of acknowledgement of the request being received.

10. Complaints

You may contact Infynite at any time if you have any questions or concerns about this Privacy Policy or about the way in which your personal information has been handled.

 

You may make a complaint about privacy to the Privacy Officer at the contact details set out below. We will handle your complaint in accordance with our internal policies as well as our obligations under the Privacy Act, and respond to you within 14 business days. 

 

If you are not satisfied with our response to your complaint, or you consider that Infynite may have breached the APPs or the Act, a complaint may be made to the Office of the Australian Information Commissioner (OAIC). The OAIC can be contacted by using the contact details at oaic.gov.au.

11. Cookies

 Our website (infynite.com.au) is hosted on Wix, which uses cookies to ensure the website functions correctly and to help us understand how visitors use the site. By using our website, you consent to the use of cookies in accordance with Wix's cookie policy.

12. Changes to this policy

We may update this privacy policy from time to time. The current version will always be available at infynite.com.au/privacy-policy. We will notify you of material changes by email where required.
